Medical Disclaimer

This document clarifies the medical status of Health OS and the limits of what the service is intended to do. It supplements the Terms of Service and Privacy Policy; in case of conflict, the Terms prevail.
1. Nature of the service
Health OS is a personal self-tracking, N-of-1 experimentation and health-data visualization tool. The service is not a medical device and is not intended for the diagnosis, prevention, monitoring, prediction or treatment of any disease or condition.
- Health OS is not certified as a medical device under EU Regulation 2017/745 (MDR), as Software as a Medical Device (SaMD) by the US FDA, or under any comparable regime in other jurisdictions.
- The service is provided strictly for informational and educational purposes.
- We do not intend to seek medical-device certification in the foreseeable future.
2. Not medical advice ⚠️
Health OS does not diagnose, prescribe or treat any condition, and does not replace consultation with a qualified physician.
- All metrics (HRV, sleep stages, SpO₂, temperature deviation, resting HR, chronotype score, cognitive test results, etc.) and their aggregates, visualizations, badges and interpretations are informational only.
- Data from consumer wearables (Oura, Whoop, Garmin, Apple Watch) and the service’s interpretation of that data are not clinical measurements. Consumer trackers and their algorithms are not validated for medical use.
- The service does not diagnose sleep apnea, ADHD, depression, anxiety disorders, hypoxia, arrhythmias, thyroid dysfunction or any other condition. Any apparent patterns visible in the dashboards are statistical observations, not clinical conclusions.
- The cognitive tests offered in the service (PVT, Stroop, N-Back, Go/No-Go) are not clinical neuropsychological instruments. They are not intended for assessing cognitive impairment, ADHD, dementia or fitness for duty.
- Before changing your sleep routine, diet, supplements or medications, insulin dosage, training program or any other material aspect of your lifestyle based on data from the service — you must consult a licensed physician.
3. Research / self-experimentation tool
The N-of-1 protocols offered by the service are personal observations, not clinical trials.
- Results have no population-level statistical power and cannot be generalized to other people.
- The
compare_phase_meansmethod (baseline vs intervention) is a simplified estimator, subject to placebo effects, regression to the mean, seasonal effects, phase ordering and uncontrolled confounders. - Protocols in the service do not replace randomized controlled trials and are not scientific publications.
- You should not recommend to other people interventions that “worked for you in Health OS” — doing so may be harmful.
- Community protocols and templates are ideas for your own investigation, not evidence-based medicine.
4. Medical emergencies ⚠️
Health OS is not designed for emergencies. The service does not operate in real time, does not continuously monitor vital signs and does not alert anyone about your condition.
If you experience:
- acute pain, especially in the chest, abdomen or head;
- shortness of breath or difficulty breathing;
- stroke symptoms (sudden numbness, confusion, trouble speaking, facial drooping);
- suicidal ideation or acute psychological crisis;
- severe allergic reaction or anaphylaxis;
- loss of consciousness, seizures;
- any other acute threat to life or health —
call emergency services immediately (112 in the EU, 911 in the US, your local emergency number elsewhere) or go to an emergency department. Do not rely on the service, do not wait for metrics to change, do not try to “figure it out from the dashboard”.
5. Data accuracy
- Data from third-party APIs (Oura, RescueTime, Google Timeline, YouTube, Whoop, etc.) may be incorrect, delayed or missing. We do not warrant the correctness, completeness or timeliness of that data.
- Analytical algorithms (chronotype score, sleep predictors, correlations, SRI, WASO, fragmentation index, alcohol detection, N-of-1 evaluation, etc.) are approximations, built on publicly available methodologies and our own reading of the literature, and are not clinically validated.
- Visualizations (charts, scores, badges, trends) simplify real physiological processes and can be misleading, especially at rare or borderline values.
- The service is in alpha: bugs, incorrect aggregates, data loss, synchronization errors and wrong units or time zones are possible.
- Historical rebuilds (backfills) can change past values when algorithms are improved.
6. User responsibility
By using Health OS, you explicitly understand and accept that:
- Medical interpretation of any data in the service is your personal responsibility.
- You will not make critical health decisions (starting or stopping a medication, changing insulin dosage, starting an extended fast, abandoning a prescribed therapy, ignoring symptoms, etc.) based on service data alone.
- Significant changes in metrics (temperature, SpO₂, resting HR, unexplained HRV drop, new sleep-fragmentation pattern, etc.) are a reason to discuss them with your physician, not to self-interpret.
- The service is not a “second opinion” — it is only a visualization and aggregation of your existing data.
- You accept the risk of data loss or corruption (alpha software) and do not rely on the service as the sole store of critical health records.
- You do not use the service to make health decisions for other people (family members, children, patients, clients, etc.).
7. Disclaimer of warranties and limitation of liability
Short version (full text in the Terms of Service, sections 10–11):
- The service is provided “AS IS”, without express or implied warranties of accuracy, fitness for medical purposes or uninterrupted operation.
- The operator is not liable for medical or medically adjacent decisions made by the user based on service data.
- The operator is not liable for harm to health caused by self-treatment, self-diagnosis, ignoring symptoms or abandoning physician-prescribed therapy because of data or the absence of data in the service.
- The operator’s aggregate liability is limited to the amount paid by the user for the service in the last 12 months (= €0 for the free alpha version).
- Nothing in this disclaimer excludes or limits liability for wilful misconduct, gross negligence, or injury to life or health where such liability cannot be limited under applicable law.
8. Acceptance
By using the service — signing in with Google, importing data, running protocols, taking cognitive tests or viewing dashboards — you acknowledge that:
- you have read and understood this disclaimer;
- you agree to the Terms of Service and the Privacy Policy;
- you use the service at your own risk;
- if you do not agree with any of these points — stop using the service and request account deletion via nik.nikitenok@gmail.com.
